The Real Estate (Regulation and Development) Act, 2016 — the most important law for homebuyers in India

RERA — the Real Estate (Regulation and Development) Act, 2016 — is a landmark legislation that fundamentally transformed how residential real estate works in India. Before RERA, buyers had almost no legal protection against delays, fund misappropriation, or misrepresentation. RERA changed that.

Under RERA, every housing project above a threshold area must be registered with the state's RERA authority before any bookings can be accepted or marketing can begin. UP RERA governs all projects in Uttar Pradesh, including Greater Noida West.

For Fab Luxe Residences, RERA registration is not optional — it is mandatory, and the application has already been filed. Once registered, the project's details, floor plans, approvals, and builder credentials will all be publicly accessible on the UP RERA portal.

Escrow Protection

70% of all buyer funds must be held in a dedicated escrow account — usable only for the project's construction. This prevents fund diversion.

Possession Date Commitment

RERA mandates a committed possession date in the agreement. Delay beyond this date triggers penalty interest payable to the buyer.

Carpet Area Transparency

Pricing must be based on carpet area — not super area or built-up area. This prevents inflated super area pricing that was common pre-RERA.

5-Year Structural Warranty

Developer is liable for 5 years post-possession for any structural defects. Complaints can be filed with RERA for rectification.

Verify RERA Registration
Check the project on uprera.in — the registration number should exist and show the project's RERA-approved details.
Confirm Builder Identity
The promoter on the RERA certificate should match who is selling you the apartment. Verify Forbes Global Properties and NBCC details.
Check Approved Plans
RERA-registered projects must upload their approved building plans. Verify tower counts, floor counts, and total units match what you're being sold.
Read the Builder-Buyer Agreement
The agreement must include the carpet area, possession date, and all charges clearly. Never sign without reading fully or getting legal advice.
Verify Land Title
Confirm land ownership is clear. For Fab Luxe, land title is Supreme Court-directed and documented through NBCC — a significant legal advantage.

After Booking

Obtain Allotment Letter
Get a signed allotment letter confirming your specific unit number, floor, super area, carpet area, and price paid.
Keep All Payment Receipts
Every payment must have an official receipt. Demand receipts even for booking amounts. Payments should always be to the company account — never personal accounts.
Register Builder-Buyer Agreement
The signed BBA should be registered with the sub-registrar's office. This legally records your purchase and protects your claim.
Monitor Construction on RERA Portal
Once registered, builders must update progress quarterly on UP RERA's portal. You can track your project's actual vs. promised construction.
Verify OC Before Taking Possession
Only accept possession when the Occupancy Certificate (OC) from the Greater Noida Authority has been obtained. OC confirms the building is legally habitable.

Use the "Project Search" function. You can search by project name ("Fab Luxe Residences"), promoter name, or registration number. Once registered, the registration number will be published here.

Verify Project Details

The RERA listing will show: promoter name and credentials, approved building plans and layouts, total number of units registered, possession timeline, and quarterly progress updates.

Cross-Check Quarterly Reports

Registered projects must file quarterly updates on UP RERA. These show actual vs. planned construction progress, fund utilisation, and any regulatory orders. Monitor these to stay informed.

Does Supreme Court monitoring replace RERA for this project?
No — Supreme Court monitoring and RERA registration are separate and complementary protections. SC monitoring governs NBCC's appointment and construction accountability.
